Terms of service

Welcome to IMPERARI. The following Terms and Conditions ("T&C") govern access to and use of our online shop, our website, and our services ("Services").
By using the Services, you agree to these T&C as well as to our Privacy Policy, Cookie Policy, Withdrawal Policy, and Shipping Policy, which form an integral part of these T&C.
If you do not agree with these terms, you may not use our Services.

1. Eligibility and Account

You must be of legal age to use our Services.
You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out through your account.

2. Orders and Conclusion of Contract

Your order constitutes a binding offer. A contract is only formed upon our acceptance in the form of a final order confirmation.

Following the placement of your order, an internal review of technical feasibility and production capacity is carried out. Final order confirmation is typically provided within 1–3 business days.

IMPERARI reserves the right to decline orders if production cannot be ensured for technical, material-related, or quality assurance reasons. In such cases, the customer will be informed without delay. Any payments already made will be fully refunded.

The production and delivery time begins upon final order confirmation by IMPERARI.

Once the order has been confirmed, orders for individually crafted pieces are binding and cannot be cancelled.

3. Prices, Payment, and Taxes

All prices are stated in Euro (EUR) and are final prices. IMPERARI applies the business regime under section 19 of the German VAT Act (Umsatzsteuergesetz, “UStG”); consequently, no value-added tax (VAT) is charged and VAT is not shown separately.

Your order is shipped by secure courier service and shipping is free of charge. No separate shipping fees are charged unless expressly stated otherwise in an individual case.

The prices displayed at checkout include all price components owed under German law at the time the order is placed. 

For deliveries within the European Union, no additional VAT will be displayed at checkout and no VAT will be charged. Any other public-law charges (e.g., national excise or consumption taxes) that may be levied in the destination country are borne by you, unless they are already shown at checkout.

For deliveries outside the European Union, delivery is generally made under Incoterms DAP / DDU (Delivered At Place / Delivered Duty Unpaid). The checkout price does not include any import duties, customs fees, or local taxes. Such charges are levied separately in accordance with the applicable laws of the destination country and must be borne in full by you. You are responsible for proper customs clearance and taxation of the goods in the destination country.

You agree to provide accurate and complete payment information and to update it promptly if it changes. The available payment methods are displayed at checkout. Your selected payment method will be charged upon completion of the order process.

4. Product Availability and Descriptions

We make every effort to display products as accurately as possible. Renderings and product images serve as design representations. Variations in dimensions, gemstone arrangement, or material appearance may occur due to artisanal manufacturing. Such deviations shall not constitute a defect and shall not give rise to any warranty claims, provided they are within customary artisanal tolerances.

IMPERARI uses only fine white pearls with high lustre. Pearls are natural materials and therefore show variations in whiteness, lustre and surface character. These natural characteristics do not constitute a defect.

Deviations in color, structure, or craftsmanship may occur due to technical or artisanal reasons.
We reserve the right to modify, discontinue, or restrict the availability of products at any time.

5. Shipping and Delivery

The details regarding shipping, delivery times, completion of delivery, and the procedure for undeliverable parcels are set out in our Shipping Policy, which forms an integral part of these T&C. All shipments are insured until successful delivery and require a signature.

For deliveries outside the European Union, shipping is carried out under Incoterms DAP / DDU (Delivered At Place / Delivered Duty Unpaid). All import duties, customs fees, and local taxes in the destination country are your responsibility and are not included in the purchase price. The details are set out in our Shipping Policy.

6. Returns and Right of Withdrawal

All jewelry pieces from IMPERARI are individually made to order and may be customized to the customer’s specifications (e.g., ring sizes, engravings, gemstone or material selection).
Therefore, there is no statutory right of withdrawal or return.

This exclusion applies worldwide and is in accordance with § 312g (2) No. 1 of the German Civil Code (BGB) and Article 16(c) of the EU Consumer Rights Directive.

Your mandatory consumer rights in the event of defective or wrongly supplied goods remain unaffected.

7. Ring Sizes and Availability

You must specify the desired ring size during checkout. IMPERARI will check feasibility.

Certain models – especially those with rare gemstones or intricate settings – may not or only partially be adjustable. In such cases, production or delivery in the requested size may not be possible.

If the requested size cannot be realized, the IMPERARI Concierge Service will contact you to propose an alternative. If no agreement is reached, IMPERARI reserves the right to cancel the order free of charge and fully refund any payments made.

There is no entitlement to delivery in any arbitrary ring size if technically impossible or if it would compromise the integrity of the piece.

8. Gemstones & Certification

IMPERARI uses exclusively natural diamonds and gemstones sourced from responsible, internationally recognised suppliers.

The specific quality characteristics of the gemstones used – including colour, clarity, cut and carat weight – are defined by the respective product specifications as well as by the accompanying certificates for individually certified diamonds (in particular from 0.30 ct, e.g. GIA).
Smaller diamonds, in particular pavé or setting stones, are not individually certified in accordance with industry practice and comply with the defined quality standards of IMPERARI.

As natural materials, diamonds may variations in colour, clarity, light reflection and visual appearance. Such natural characteristics do not constitute a defect.

All gemstones are professionally set and correspond to the standards specified for each jewellery piece.

9. Intellectual Property

All content (e.g., images, logos, product designs) is the property of IMPERARI or duly licensed.
Use without prior written consent is prohibited.

10. Third-Party Tools and Links

Our Services may refer to third-party services or content.
We are not responsible for such content, availability, or privacy practices.

11. Data Protection and Cookies

The processing of personal data is carried out in accordance with our Privacy Policy and Cookie Policy.

12. Feedback and Submissions

Any content, ideas, or feedback you submit may be used by us free of charge and without restriction for business purposes.

13. Prohibited Use

You may not use the Services for unlawful, fraudulent, abusive, or harmful purposes.
We reserve the right to suspend or terminate accounts in the event of violations.

14. Limitation of Liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from the use of our Services or products.
This limitation does not apply where negligence causes injury to life, body, or health, or where liability is mandatory by law.

15. Indemnification

You agree to indemnify IMPERARI against third-party claims resulting from your unlawful use of our Services or breach of these T&C.

16. Changes to the Terms

We reserve the right to amend these T&C from time to time.
Substantial changes will be announced via email or on our website.
Continued use of the Services constitutes acceptance of the updated T&C.

17. Governing Law and Jurisdiction

These T&C are governed by the laws of the Federal Republic of Germany.
The courts at the registered office of IMPERARI shall have jurisdiction.
Mandatory consumer protection laws and the right to bring legal proceedings in your country of residence remain unaffected.

18. Contract Language and Documentation

The contractual language is English. Where translations into other languages are provided, these are for information purposes only. In the event of discrepancies, the English version shall prevail.
